Memorandum from the Department for Environment,
Food and Rural Affairs
ENVIRONMENTALLY SENSITIVE AREAS (STAGE II) DESIGNATION
(AMENDMENT) (NO. 2) ORDER 2001 (S.I. 2001/3774)
1. By a letter dated 18th December 2001, the Committee
has requested that a memorandum be submitted on the following
Since this instrument corrects errors in an earlier
instrument, has the Department (as required by paragraph 3.24
of Statutory Instrument Practice) made arrangements for copies
of the amending instrument to be made available free of charge
to all known recipients of the earlier instrument? If so, explain
why the amending instrument does not bear a headnote to that effect
(see paragraph 3.25 of the Statutory Instrument Practice).
2. Arrangements had been made for the amending instrument
to be made available free of charge to all known recipients of
the earlier instrument. However, the Department regrets that,
by an oversight, the headnote was not added to it. As the instrument
has not yet, at the time of writing, been published, arrangements
have been made with the Stationery Office for the headnote (appropriately
amended) referred to in paragraph 3.25 of Statutory Instrument
Practice to be added to the instrument prior to publication. Publication
is expected on 27th December 2001.
3. The Department apologises for the oversight.
