PRESSURE EQUIPMENT (AMENDMENT) REGULATIONS 2002
- The Joint Committee has requested a memorandum on the following :
"Explain the purpose of sub-paragraph (a) of regulation 2(4) of the 1999 Regulations inserted by regulation 2(1), giving examples of circumstances in which pressure equipment or an assembly which is made available in the Community would not fulfil this condition."
- The purpose of regulation 2(4) is to exempt from the requirements of the Pressure Equipment Regulations 1999 (S.I. 1999/2001) relating to placing on the market pressure equipment or assemblies used by persons otherwise than in the course of business at all times prior to their being made available in the Community. The Department acknowledges, on reflection, that there are no circumstances in which pressure equipment or assemblies which are made available in the Community would not fulfil the condition in sub-paragraph (a) of Regulation 2(4) and therefore accept that this sub-paragraph is otiose.
- The Department will amend the provision when a suitable opportunity arises.
