HILL FARM ALLOWANCE REGULATIONS 2001 (S.I. 2001/476)
1. By a letter dated 14 March 2001, the Committee
has requested that a memorandum be submitted on the following
Regulation 2(1) defines "ewe"
as meaning " a female sheep which is at least one year old,
or has lambed, on 1 January 2001". Is it intended that the
sheep must have lambed on 1 January 2001 to qualify, or that it
should have lambed by that date? If the latter meaning is intended,
ought not the definition to have read: "ewe" means a
female sheep which on 1 January 2001 is at least one year old
or has lambed by that date?
2. The Committee has correctly pointed out a possible
ambiguity. The definition should refer to a female sheep which
is at least one year old on 1 January 2001 or has lambed before
that date. The Regulations will be amended at the first opportunity.
