2    Delegated Powers and Regulatory Reform
The Delegated Powers and Regulatory Reform Committee reported that, pursuant to section 15 of the Legislative and Regulatory Reform Act 2006, they recommend that the super-affirmative resolution procedure should apply to the draft Legislative Reform (Local Authority Consent Requirements) (England and Wales) Order 2007.

Private Business

3    Transport for London Bill [HL] A message was brought from the Commons that they have made the following order:

That the promoters of Transport for London Bill [Lords], which was originally introduced in the House of Lords in the previous session on 23 January 2006, should have leave to suspend any further proceedings on the bill in order to proceed with it, if they think fit, in the next session of Parliament, according to the provisions of Private Business Standing Order 188A (Suspension of bills).

9    Legal Services Bill [HL] The Commons amendments were considered. Commons amendments were agreed to. Commons amendment 4 was disagreed to and amendment 4A in lieu thereof was

agreed to (see division list 1). Commons amendments 10 to 14 were disagreed to and amendments 10A, 11A, 11B, 12A, 13A, 14A and manuscript amendment 14C in lieu thereof were agreed to. Amendment 15A to Commons amendment 15 was agreed to (see division list 2) and Commons amendment 15 was agreed to as amended. A motion to disagree with a Commons amendment was disagreed to (see division list 3). A motion to disagree with Commons amendment 74 was agreed to (see division list 4). Commons amendments 75 to 77 and 81 to 88 were disagreed to. The remaining Commons amendments were agreed to.

A Committee was appointed to propose reasons. The following Lords were members of the Committee:

The Committee proposed the following reason for disagreeing with Commons Amendments 74 to 77 and 81 to 88:

“Because it is appropriate that the appointment and removal from office of the chairman and ordinary members of the Legal Services Board should be subject to the concurrence of the Lord Chief Justice.”

The reason was agreed to. The bill was returned to the Commons with amendments and reasons.

10    Improving the mental health of the population (EUC Report) Baroness Thomas of Walliswood moved that this House takes note of the Report of the European Union Committee on Improving the mental health of the population: can the European Union help? (14th Report, HL Paper 73). After debate, the motion was agreed to.

It was ordered and adjudged that, in the appeal of Abdroikof, the Order of Her Majesty’s Court of Appeal Criminal Division of 28 July 2005 be affirmed so far as regards the said appellant, the appeal dismissed and the certified question set out in the said Order answered in accordance with the opinions expressed in this House; that, in the appeal of Green, the appeal be allowed, the Order of Her Majesty’s Court of Appeal Criminal Division of 28 July 2005 set aside so far as regards the said appellant, the appellant’s convictions for offences of assault occasioning actual bodily harm and having a blade or pointed article at the Crown Court at Woolwich on 5 October 2004 quashed and the certified question set out in the said Order answered in accordance with the opinions expressed in this House; that, in the appeal of Williamson, the appeal be allowed, the Order of Her Majesty’s Court of Appeal Criminal Division of 28 July 2005 set aside and the cause remitted to Her Majesty’s Court of Appeal Criminal Division for reconsideration in the light of the opinions expressed in this House, and the certified question set out in the said Order answered in accordance with the opinions expressed in this House. 4    R v Kennedy (Appellant) (On Appeal from the Court of Appeal (Criminal Division)) It was moved by Lord Bingham of Cornhill that the 47th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the appeal be allowed; that the Order of Her Majesty’s Court of Appeal Criminal Division of 17 March 2005 be set aside and the appellant’s conviction for manslaughter at the Central Criminal Court on 26 November 1997 quashed; that the certified question set out in the Order of Her Majesty’s Court of Appeal Criminal Division of 18 July 2005 be answered as follows: “In the case of a fully-informed and responsible adult, never”; and that the costs of the appellant incurred in this House and below be paid out of central funds in accordance with section 16 of the Prosecution of Offences Act 1985, the amount thereof to be certified by the Clerk of the Parliaments. It was ordered and adjudged that the Order of Her Majesty’s Court of Appeal of 24 January 2007 be affirmed and the appeal dismissed; and that the question of the costs of the appeal to this House be adjourned in order that the parties may make written submissions within 14 days. 10    United Utilities Water plc (Appellants) v Environment Agency for England and Wales (Respondents) It was moved by Lord Hoffmann that the 50th Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the Order of Her Majesty’s Court of Appeal of 19 May 2006 be affirmed and the appeal dismissed; and that the question of costs in this House be adjourned in order that the parties may make written submissions within 14 days. 11    Moncrieff and another (Respondents) v Jamieson and others (Appellants) (Scotland) It was moved by Lord Hope of Craighead that the 51st Report from the Appellate Committee be agreed to; the motion was agreed to. It was ordered and adjudged that the Interlocutor of an Extra Division of the Inner House of the Court of Session in Scotland of 4 February 2005 be affirmed and the appeal dismissed; and that the question of the costs of the appeal to this House and of the expenses in the courts below be adjourned in order that the parties may make written submissions within 14 days [2007] UKHL 42

12    United Utilities plc (Appellants) v Her Majesty’s Commissioners of Customs and Excise (Respondents) Upon application by the appellants (the agents for the respondents consenting thereto), it was ordered that the appeal be withdrawn and that no order be made as to costs.

Lord Kingsland moved, as an amendment to the motion that this House do agree with the Commons in their Amendment 4, to leave out from “House” to end and insert “do disagree with the Commons in their Amendment 4 but do propose Amendment 4A in lieu—

in clause 15, page 7, line 15, at end to insert:

“(5A)    Where P is an independent trade union, persons provided with relevant services do not constitute the public or a section of the public in the circumstances specified in subsection (5B).

(5B)    The circumstances are—

(a)    the persons are provided with the services by virtue of

(i)    their membership or former membership of P, or

(ii)    another person’s membership or former membership of P,

(b)    the services are provided to the persons in connection with any matter which arises out of the terms and conditions of their employment, their treatment by their employers, their workplace relationships or their workplace or other working conditions, and

(c)    any such employment, employer or workplace is one in respect of which P represents, or seeks to represent, workers as a trade union.””
