Mushtaq (Appellant)—The appeal of Ashfaq Ahmed Mushtaq was presented and ordered to be prosecuted subject to the procedures applicable thereto (lodged on 12th December). 3. Savings and Investments Bank Limited (in liquidation) (Petitioner) v. Fincken (Respondent)—The petition of Savings and Investment Bank Limited (in liquidation) praying for leave to appeal was presented and referred to an Appeal Committee (lodged on 11th December). 4. Hudson and others (Petitioners) v. Barker Booth and Eastwood (a firm) (Respondents)—The petition of the appellant praying that the time for lodging the statement and appendix and setting down the cause for hearing might be extended to 13th January next (the agents for the respondents consenting thereto) was presented; and it was ordered as prayed. 8. In re I (FC) (Respondent) (application for a writ of Habeas Corpus)—The petition of the appellant was presented praying that the appeal be withdrawn on the terms that a) the appellant do pay the respondent’s costs before the House, the amount thereof to be certified by the Clerk of the Parliaments if not agreed between the parties; and b) the costs of the appellant be taxed in accordance with the Access to Justice Act 1999 (the agents for the respondent consenting thereto); and it was ordered as prayed. Select Committee Reports 12. Statutory Instruments—The 3rd Report from the Joint Committee was made on certain statutory instruments, including the following affirmative instruments: Draft European Communities (Definition of Treaties) (Common Electoral Principles) Order 2004; Draft New Opportunities Fund (Specification of Initiative) Order 2004; Draft Solvent Emissions (England and Wales) Regulations 2004; it was ordered that the Report be printed. (HL Paper 14) 13. Science and Technology—The First Report from the Select Committee, Chips for Everything: follow-up, was made; it was ordered that the Report be printed. (HL Paper 15) Public Business 14. Statute Law (Repeals) Bill [HL]—A bill to promote the reform of the statute law by the repeal, in accordance with recommendations of the Law Commission and the Scottish Law Commission, of certain enactments which (except in so far as their effect is preserved) are no longer of practical utility, and to make other provision in connection with the repeal of those enactments was presented by the Lord Filkin on behalf of the Lord Falconer of Thoroton, read a first time and ordered to be printed. Business of the House—It was moved by the Lord President (Baroness Amos) that Standing Order 47 (No two stages of a Bill to be taken on one day) be dispensed with to allow the Consolidated Fund Bill to be taken through all its stages today; the motion was agreed to. Consolidated Fund Bill—It was moved by the Lord McIntosh of Haringey that the bill be now read a second time; the motion was agreed to and the Committee was negatived; then, Standing Order 47 having been dispensed with, the bill was read a third time and passed. 17. Extradition Act 2003 (Designation of Part 2 Territories) Order 2003—It was moved by the Baroness Scotland of Asthal that the draft Order laid before the House on 3rd December be approved; after debate, the motion was agreed to. 18. Extradition Act 2003 (Designation of Part 2 Territories) Order 2003—It was moved by the Lord Goodhart that this House calls on Her Majesty’s Government to withdraw the draft Extradition Act 2003 (Designation of Part 2 Territories) Order 2003 and lay a new draft Order deleting the reference to the United States of America in paragraph 3 of the Order; the motion was disagreed to (see division list). 19. Extradition Act 2003 (Police Powers: Code of Practice) Order 2003—It was moved by the Baroness Scotland of Asthal that the draft Order laid before the House on 3rd December be approved; after debate, the motion was agreed to. 20. Export of Goods, Transfer of Technology and Provision of Technical Assistance (Control) Order 2003—It was moved by the Baroness Miller of Hendon that an Humble Address be presented to Her Majesty praying that the Order, laid before the House on 31st October, be annulled (S.I. 2003/2764); after debate, the motion was (by leave of the House) withdrawn. 23. Justice (Northern Ireland) Bill [HL]—It was moved by the Lord President (Baroness Amos) that the bill be now read a second time; after debate, the motion was agreed to and the bill was committed to a Committee of the Whole House. 24. Financial Statement and Budget Report—It was moved by the Lord McIntosh of Haringey that this House takes note with approval of Her Majesty’s Government’s assessment as set out in the Pre-Budget Report 2003 for the purposes of section 5 of the European Communities (Amendment) Act 1993; after debate, the motion was agreed to.
