Letter from the Chairman to Melanie Johnson MP, Parliamentary Under-Secretary of State for Competition, Consumers and Markets, Department of Trade and Industry

  The Commission's Working Document was considered by Sub-Committee E (Law and Institutions) at its meeting on 28 October. As the Committee said in its Report on the Community Patent (The Community Patent and the Patent System in Europe, 1997-98, 26th Report) the Community Patent must be supported by judicial arrangements which command the confidence of industry. We support the creation of a Community Patent Court integrated into the Community Courts. The Commission's Working Document is a most helpful contribution to the negotiations on the Community Patent Regulation.

  The Committee decided to clear the document from scrutiny. We would be grateful if you could keep us informed of developments in the negotiations. We note that there may be some discussions of the Community Patent at the Competitiveness Council next month. We would be grateful for a brief report of that and in particular an indication as to whether progress is being made in dealing with the languages issue.
