Letter from the Chairman to Mr David Jamieson MP, Parliamentary Under-Secretary of State, Department of Transport

  Thank you for your Explanatory Memorandum dated 21 May which Sub-Committee B considered at its meeting on 10 June. The amended proposal seems to have taken an inordinate time to reach Parliament—it was deposited on 25 February 2002.

  The amendments are clearly an improvement on the draft proposal and are to be welcomed. We note, with satisfaction, the revised exemptions for metro/light-rail systems, as well as those changes which allow existing competitively procured contracts to remain in place. But, we note that you still require clarification of the scope of provisions in article 10 relating to the imposition by authorities of general rules to be adhered to by all operators, and also on the application of this regulation vis-a"-vis the public procurement Directives.

  In the circumstances, the Scrutiny reserve on this document is maintained until you are able to throw more light on these two particular concerns. We note that further action on this dossier has been postponed until the Danish Presidency.
