Food and Rural Affairs, to the Chairman
The Delegated Powers and Regulatory Reform Committee
met on Wednesday 26 February to discuss the Water Bill and the
Department's Memorandum. Your findings were published in the 12th
Report of this Session.
This Report recommended (in paragraphs 17 and 18)
that two proposed Henry VIII powers in the Water Bill should be
amended so that they are subject to affirmative, rather than negative,
procedure. I am content to agree that we follow the affirmative
procedure where orders or regulations amend or repeal an Act of
Parliament but that otherwise we maintain the negative procedure.
I will ensure that amendments to this effect are tabled at the
28 February 2003
