Select Committee on Delegated Powers and Regulatory Reform Third Report

Children (Scotland) Act 1995, section 105(6)

105  Extent, Short title, minor and consequential amendments, repeals and commencement

(6)  The Secretary of State may by order made by statutory instrument make such further amendments or repeals, in such enactments as may be specified in the order, as appear to him to be necessary or expedient in consequence of any provision of this Act.

Parliamentary procedure: negative (section 105(7)).

Departmental explanation: none (as introduced no Parliamentary procedure was provided).

Committee Report (8th of 1994-95):

"This could be considered a Henry VIII clause and the House may wish to consider whether it should be subject to some Parliamentary control. The House may consider the negative procedure appropriate as the power is limited to the making of consequential amendments and repeals."
