HOUSEHOLD WASTE RECYCLING BILL

Introduction

38.  This is a private member's bill concerning the collection, composting and recycling of household waste. The Department for Environment, Food and Rural Affairs has provided a memorandum for the Committee on the delegated powers in the bill. The memorandum is printed at Annex 5 to this Report.

39.  Clause 1 inserts a new section 45A into the Environmental Protection Act 1990. New section 45A imposes a requirement relating to separate collection of recyclable waste in English waste collection authorities. Under section 45A the requirement applies from 31 December 2010, but the Secretary of State may, on a request from an English authority, direct that the requirements apply to that authority from a later date (but not later than 31 December 2015).

40.  Clause 2 inserts new section 45B which enables the National Assembly for Wales by order (subject to Welsh Assembly procedures) to apply section 45A to Wales, in which case the direction-making power vests, as respects Wales, in the Assembly.

Conclusion

41.  THERE IS NOTHING IN THIS BILL TO WHICH THE COMMITTEE WISHES TO DRAW THE ATTENTION OF THE HOUSE.
