SUNDAY WORKING (SCOTLAND) BILL

INTRODUCTION

21.  This is a private member's bill brought from the House of Commons. The Scotland Office has provided a memorandum on the delegated powers in the bill for the Committee. The memorandum is printed at Annex 4 to this Report. The purpose of the bill is to make provision as to the rights of shop workers and betting workers under the law of Scotland in relation to Sunday working.

THE DELEGATED POWERS

22.  There are two delegated powers - at clauses 2 and 3 - conferred in each case on the Secretary of State and subject to no Parliamentary procedure. Clause 3 is a power to make a commencement order and clause 2 is a power to make transitory, transitional or saving provision in consequence of or for giving full effect to the bill. This is not expressed to enable other enactments to be overridden and it has long been unexceptionable for such limited provision to be included with commencement orders.

CONCLUSION

23.  There is nothing in the delegated powers in the bill to which the Committee wishes to draw the attention of the House.
