Clause 1

Page 1, line 16, leave out from "State" to end of line 17 and insert "shall—
(a)  cause a public inquiry to be held if the person who made the objection referred to in sub-paragraph (1) notifies the Secretary of State in writing that they wish an inquiry to be held, or"

Page 2, line 40, leave out from "State" to end of line 41 and insert "shall—
(a)  cause a public inquiry to be held if the person who made the objection referred to in sub-paragraph (1) notifies the Secretary of State in writing that they wish an inquiry to be held, or"
Page 3, line 18, at end insert—
"(1)  Schedule 3 to the 1964 Act shall be amended as follows.
(2)  After paragraph 18 there shall be inserted—
 

"Rules in connection with objections

 18A   (1)   The Secretary of State may make rules as to—
(a)  the making of objections to an application for orders under section 14 or 16 or the making of orders under section 15;
(b)  the information to be comprised within or submitted with an objection;
(c)  the submission by the person making the application of written representations or information in relation to objections;
(d)  the submission of further written representations or information;
(e)  such other matters relating to the consideration of objections as appear to the Secretary of State to be appropriate.
(2)  The Secretary of State shall not make a determination under paragraph 19 to make an order without first taking into consideration the grounds of any objection in respect of which rules under this section have been complied with.""
Page 3, line 18, at end insert—
"(   )  In section 14(2)(b) (Ministers' powers, on application of harbour authorities, or others, to make orders for securing harbour efficiency, &c) of the 1964 Act, after `sea-going ships' insert "or for conserving natural beauty, flora, fauna, geological, physiographic features and all other natural features"
Page 3, line 18, at end insert—
"(   )  After section 48A (environmental duties of harbour authorities) there shall be inserted—
"48BContributing to sustainable development
(   )  In the exercise of any function under this Act, the appropriate Minister must have regard to the desirability of contributing to the achievement of sustainable development."."
Page 3, line 18, at end insert—
"(   )  After section 15A (Ministers' powers to make orders about port appointments) of the Harbours Act 1964 Act there shall be inserted—
"15BPort appointments as regards the environment
(1)  The Secretary of State shall appoint such number of persons with knowledge of or expertise in marine environmental matters as he thinks fit as further members of a harbour authority.
(2)  In this section "marine environmental matters" means—
(a)  the conservation or enhancement of the natural beauty or amenity of marine or coastal areas (including their geological or physiographical features) or of any features of archaeological or historic interest in such areas; or
(b)  the conservation of flora or fauna which are dependent on, or associated with, a marine or coastal environment.""
