It was moved by the Earl Russell, in Clause 24, page 13, line 26, at end to insert:

“( ) The Secretary of State may not stop providing support under section 15 or 22 of this Act where—

(a) to stop providing such support would render the person or any dependant of his destitute within the meaning of section 17 of this Act or section 95 of the Immigration and Asylum Act 1999 (c. 33) (provision of support), and

(b) 1the Secretary of State has not provided or arranged for the provision of support for the person under section 4 (accommodation for those temporarily admitted or released from detention) or section 95 of the Immigration and Asylum Act 1999.”;

which being objected to, the question was put thereupon, and the House divided:
