Clause 31

 

THE LORD WALLACE OF SALTAIRE

Page 29, line 32, leave out subsections (2) to (7) and insert—
"(2)  Members of the Ministry of Defence Police shall, on request of a chief constable of a Home Office Police Force adjacent to land defined in section 2(2) (a) (b) (c) of the Ministry of Defence Police Act 1987 (c. 4), and by agreement with the chief constable of the Ministry of Defence Police, be attested as special constables of the Home Office Police Force in that area, under the Police Act 1996 (c. 16).
(3)  When taking part in any operations or investigations which may result in the prosecution of individuals or groups of individuals not employed by the Secretary of State for Defence or the Defence Council or subject to the control of the Defence Council, members of the Ministry of Defence Police shall act in their capacity of Special Constables of a Home Office Police Force, responsible to the chief constable of the Home Office Police Force in which they are attested."
Page 30, line 37, at end insert "provided that such members of the Ministry of Defence Police have been placed formally under the authority of the police force which has requested such assistance for the duration of the investigation or operation"
 

After Clause 32

 

THE LORD WALLACE OF SALTAIRE

Insert the following new Clause—
  "Joint Committee
  After section 2 of the Ministry of Defence Police Act 1987 (c. 4) there is inserted—
      "2A Joint Committee
    (1)  There shall be a Joint National Home Office Police and Ministry of Defence Police Committee, its purpose being to advise the Secretary of State for the Home Department and Secretary of State for Defence, as they may require, on all matters concerning operations and liaison between the Home Office Police Forces and the Ministry of Defence Police.
    (2)  At least two-thirds of the members of the Committee shall be appointed by the Secretary of State for the Home Department and the remainder shall be appointed by the Secretary of State for Defence.
    (3)  The Committee shall make an annual report to the Secretary of State for the Home Department, which he shall present to Parliament.""

Page 66, line 30, at end insert—
    "(   )  At least a half of the Committee shall be constituted of persons independent of the Ministry of Defence, to be appointed on the advice of the Association of Police Authorities.
    (   )  In its procedures the Ministry of Defence Police Committee shall follow the guidelines for procedure agreed for police authorities for civilian forces, subject to specific exceptions agreed between the members of the Committee and the Secretary of State."
Page 66, line 37, at end insert—
    "(   )  Such assistance shall be provided from the normal establishment of the Ministry of Defence Police and no provision shall be made in determining the Ministry of Defence Police establishment for a reserve to support civilian forces."
Page 70, line 22, leave out subsection (3) and insert—
"(3)  The Secretary of State shall send a copy of the published report—
(a)  to the Ministry of Defence Police Committee, acting as the police authority for this force, and
(b)  to the chief constable of the Ministry of Defence Police.
(3A)  The police authority shall invite the chief constable to submit comments on the published report to the authority before such date as it may specify.
(3B)  The police authority shall prepare comments on the published report and, after consultation with the Secretary of State, shall arrange for—
(a)  its comments;
(b)  any comments submitted to the chief constable in accordance with subsection (3A);
(c)  any response which the authority has to the comments submitted by the chief constable,
  to be published in such manner as appears to the authority to be appropriate."
