TO

Amend the Parliament Act 1911 and to make further provision on the financial powers of the House of Lords.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Amendment of Parliament Act 1911.     1. - (1) The Parliament Act 1911 is amended as follows.
 
      (2) After section 1 there shall be inserted-
 
 
"Tax provisions in Money Bills: Lords powers.     1A. Section 1(1) above shall apply only to those provisions of a Money Bill relating to the imposition, repeal, remission, alteration or regulation of taxation which concern the type and rate of tax or its incidence on persons, transactions or properties."
 
Tax provisions in Bills other than Money Bills: Lords powers.     2. Notwithstanding the privileges of the House of Commons with respect to aids and supply, the House of Lords shall have the power to amend the taxation provisions of Finance Bills which are not certified as Money Bills by the Speaker of the House of Commons, other than those provisions therein contained which concern the type and rate of tax and its incidence on persons, transactions or properties.
 
Short title.     3. This Act may be cited as the House of Lords Financial Powers Act 2001.
