        (1A)  No person may operate a vehicle under the provisions of subsection (1) unless he has been granted a special types licence for the vehicle by the Secretary of State.
        (1B)  The Secretary of State shall not grant a licence under subsection (1A) if it appears to him that the applicant is technically incompetent."")

     ("  .  After section 44 of the Road Traffic Act 1988 insert--Requirement for special types license.
 REQUIREMENT FOR SPECIAL TYPES LICENCE> 
 Offence to use unlicensed vehicle.     44A.--It is an offence for a person to use any vehicle under an order made by section 44 of this Act if the vehicle is not licenced under that section. 
 Special types license.     44B.--(1)  A special types licence issued by the Secretary of State shall have effect for a prescribed period of--
    (a)  one week;
    (b)  two weeks;
    (c)  one month; or
    (d)  multiples of three, but not more than twelve, months.
    (2)  A special types licence of a duration of one month or less shall not be refundable.
 
    (3)  The Secretary of State may by regulations provide that the special types licence shall be fixed, in a manner prescribed by the regulations, on the vehicle, on any other vehicle drawn by the vehicle or on both.
 
    (4)  There shall be charged by the Secretary of State in respect of the grant of special types licences such fees as may be prescribed subject to subsection (5) and (6) below.
 
    (5)  Fees which are prescribed under subsection (4) shall--
    (a)  take into account the probability of increased road wear,
    (b)  take into account the probable need for police escorts, and
    (c)  not exceed the highest rate of tax for goods vehicles under the Vehicle Excise and Registration Act 1994.
    (6)  Fees which are prescribed under subsection (4) may be reduced to the extent of any national vehicle duty already paid in respect of the vehicle.
 
    (7)  In this section "national vehicle duty" means duty levied under the Vehicle Excise and Registration Act 1994 or any national equivalent provision of a Member State of the European Union."")
