Clause

Make provision about fees for television licences in residential care accommodation.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Reduced fee television licences: residential care accommodation.     1. - (1) The Wireless Telegraphy (Television Licence Fees) Regulations 1997 ("the 1997 Regulations") shall be amended as follows.
 
      (2) In Part I of Schedule 2, in column 2 of entry 5, after "accommodation", the second time it occurs, there is inserted "or communal rooms intended for use solely by residents in that accommodation".
 
      (3) In Part II of that Schedule-
 
 
    (a) at the end of paragraph 1(b)(ii), and
 
    (b) in paragraphs 2(a), 3(a), 4(a), 5(a), 6(a) and 7(a), after the words "of pensionable age",
       there is inserted "and men between the ages of 60 and 64 who continue to be employed".
 
Free television licences: persons 75 years or over in residential accommodation.     2. - (1) Where a scheme exists for the issue, free of charge, of licences to instal and use television receivers (as defined by section 1(7) of the Wireless Telegraphy Act 1949) to persons 75 years of age or over, the Secretary of State has a duty to ensure that the scheme is made in accordance with the following provision.
 
      (2) That provision is that licences shall be granted for use in accommodation for residential care where all residents are 75 years of age or over both-
 
 
    (a) in living rooms or bedrooms provided for the private occupation of residents, and
 
    (b) in any communal room intended solely for use by residents.
      (3) In subsection (2) above, "accommodation for residential care" has the same meaning-
 
 
    (a) in relation to England and Wales, as in paragraph 2,
 
    (b) in relation to Scotland, as in paragraph 3,
 
    (c) in relation to Northern Ireland, as in paragraph 4,
 
    (d) in relation to Jersey, as in paragraph 5,
 
    (e) in relation to Guernsey, as in paragraph 6,
 
    (f) in relation to the Isle of Man, as in paragraph 7,
       of Part II of Schedule 2 to the 1997 Regulations.
 
Short title and extent.     3. - (1) This Act may be cited as the Wireless Telegraphy (Television Licence Fees) Act 2000.
 
      (2) This Act extends to Northern Ireland.
