 Prohibition on promoting homosexuality.403B.--(1) Local education authorities, governing bodies and head teachers must ensure that sex education given to registered pupils in a maintained school does not-- 
      (a)  intentionally promote homosexuality;
      (b)  employ materials promoting homosexuality;
      (c)  teach the acceptability of homosexuality as a pretended family relationship.
        (2)  Nothing in subsection (1) shall be taken to prohibit the giving of any education about treating or preventing the spread of disease.
        (3)  In any proceedings in connection with the application of this section a court shall draw such inferences as to the intention of the local education authority, governing body or head teacher (as the case may be) as may reasonably be drawn from the evidence before it.
        (4)  In this section "maintained school" has the meaning given in section 403A."")
