Statutory Nuisances (Hedgerows in Residential Areas Bill [H.L.]
1.Statutory nuisance.
2.Short title.





Make provision for hedgerows in residential areas to be a statutory nuisance.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-

Statutory nuisance.     1. - (1) Section 79 of the Environmental Protection Act 1990 (statutory nuisances) is amended as follows.
      (2) In subsection (1) (list of statutory nuisances), after paragraph (a), there is inserted-
    "(aa) any hedgerow planted in such a place, or maintained in such a manner, as to be prejudicial to health or a nuisance;".
      (3) In subsection (7) (interpretation), after the definition of "gas", there is inserted-
    " "hedgerow" means any hedge forming a boundary between two private dwellings;".
Short title.     2. This Act may be cited as the Statutory Nuisances (Hedgerows in Residential Areas) Act 2000.
