Make it an offence to drive while using a hand-held mobile telephone.

BE IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:-
 

Offence of driving while using a hand-held mobile telephone.     1. In the Road Traffic Act 1988, before section 4 insert-
 
 
"Driving while using a hand-held mobile telephone.     3B. If a person drives a mechanically propelled vehicle on a road or other public place while making, receiving or conducting a telephone call using a hand-held mobile telephone he is guilty of an offence."
 
Penalty.     2. In Part 1 of Schedule 2 to the Road Traffic Offenders Act 1988 (prosecution and punishment of offenders), before the entry relating to section 4(1) of the Road Traffic Act 1988 insert-
 
 
 
"RTA section 3B
 
Driving while using a hand-held mobile telephone.
 
Summarily.
 
Level 4 on the standard scale.
 
Discretionary.
 
Obligatory.
 
3-9."
Short title and extent.     3. - (1) This Act may be cited as the Road Traffic (Use of Mobile Telephones) Act 1999.
 
      (2) This Act does not extend to Northern Ireland.
