Joint Committee on Statutory Instruments Twelfth Report

APPENDIX 3

Memorandum from the Home Office

DRAFT REHABILITATION OF OFFENDERS ACT 1974 (EXCEPTIONS) (AMENDMENT) (ENGLAND AND WALES) ORDER 2003

Consolidation

1. The Department is aware that the Rehabilitation of Offenders Act 1974 (Exceptions Order 1975 has become very complex as a result of a number of amendment orders and has considered the need to consolidate. However, the Rehabilitation of Offenders Act 1974 has been subject to a fundamental review and advanced drafting authority has been granted for new legislation to replace the 1974 Act with a view to introducing a Bill when parliamentary time allows. Against this background, the Department does not consider it sensible to draft a consolidation order at this stage, bearing in mind the significant resources that would be needed for such a task.
