Memorandum from the Department for Transport


1. The Committee has asked for a memorandum on the following point:

Regulation 24(5)(a)(iii) requires the vehicle trader to deliver to the Secretary of State a declaration signed by the registered keeper. Are the vehicle trader and the registered keeper the same person? If so, why does it not refer to a declaration signed by the vehicle trader? If not, who is the registered keeper and how is he expected to give the necessary declaration?

2. The declaration should be given by the vehicle trader who could, but would not necessarily, be the registered keeper. The Department will accordingly amend the instrument at the earliest opportunity so as to make the intention clear. The Department is obliged to the Committee for drawing attention to the point.
