S.I. 2003/2577: memorandum from the Department for Environment, Food and Rural Affairs

Olive Oil (Marketing Standards) Regulations 2003 (S.I. 2003/2577)

1. The Joint Committee on Statutory Instruments has requested the Department to submit a memorandum on the following point:

"Regulation 8 provides that any person guilty of an offence under regulations 4,5,6 or 7 shall be liable on summary conviction to a fine not exceeding the statutory maximum. Ought not the underlined words to have read "level 5 on the standard scale", given the offence is triable only summarily?"

2. The Department accepts that the reference should have been to "level 5 on the standard scale". The error is regretted, and will be corrected in a forthcoming amendment of the Regulations required to update references to recently amended Community law.
