Joint Committee on Statutory Instruments Thirtieth Report

3 S.I. 2003/1871: defective drafting

Consular Fees Order 2003 (S.I. 2003/1871)

3.1 The Committee draws the special attention of both Houses to this Order on the ground that it is defectively drafted.

3.2 This Order increases certain passport fees. In relation to applications made in person in the United Kingdom for a passport of 48 pages, new Fee 13(b) (i) and (ii) specifies two different fees (£71 and £84.50) for "using the fast-track service". In a memorandum printed in Appendix 3, the Foreign and Commonwealth Office acknowledges that "fast-track service" in (ii) should have read "fast-track collect service" so that the fee of £84.50 would be payable in respect of the latter service. The Department undertakes to correct the error at the first opportunity. The Committee reports the Order for defective drafting, acknowledged by the Department.
