S.I. 2003/1727: memorandum from
the Department for Work and Pensions
Occupational Pension Schemes (Transfer Values
and Miscellaneous Amendments) Regulations 2003 (S.I. 2003/1727)
1. The Committee has asked the Department to submit
an Explanatory Memorandum on the above mentioned Instrument dealing
with the following point:
Regulation 8(4) of the Occupational Pension Schemes
(Transfer Values) Regulations 1996, as substituted by regulation
2(3) of S.I. 2003/1727, consists of a single sentence of 14 lines.
Similar amendments are made to other Regulations by regulations
4(3), 5(3) and 6(3). Does the department agree that in each case
it would have been possible and preferable to have divided the
material into a series of shorter paragraphs to assist the reader?
2. The Department accepts the point made by the Committee
that it would have been possible and preferable to assist the
reader by dividing the material into a series of shorter paragraphs.
The Department is aware of best practice in this area and will
remind its draftsmen about this.
3. In the event that the need arises in future to
make further amendments to the Occupational Pension Schemes (Transfer
Values) Regulations 1996, the Department will revisit the points
made by the Committee in an attempt to bring the drafting of these
provisions in line with best practice.
