Memorandum from the Department for Transport

MERCHANT SHIPPING (MEDICAL EXAMINATION) REGULATIONS 2002 (S.I. 2002/2055)

1. The Joint Committee on Statutory Instruments has asked the Department to submit a memorandum on the following point:

Regulation 2(1) contains, in the definition of "pleasure vessel", a definition of "immediate family". Explain the meaning of "a relative" in the latter and why the corresponding definition in regulation 2(1) of S.I. 2002/2125 does not include relatives.

2. The intended meaning of "a relative" is a brother, sister, ancestor or lineal descendant of an individual or the husband or wife of that individual. The corresponding definition in regulation 2(1) of S.I. 2002/2125 accurately conveys the intended meaning. The words "and a relative of the individual or the individual's husband or wife" were erroneously included in S.I. 2002/2055.

3. The Department apologises for this error and will amend the Regulations as soon as possible.
