Second Memorandum by the Northern Ireland Court Service

LEGAL AID IN CRIMINAL PROCEEDINGS (COSTS) (AMENDMENT NO. 2) RULES (NORTHERN IRELAND) 2001 (S.R. 2001/426)

1. The Committee has requested elaboration on the nature of the administrative error referred to in the Court Service Memorandum dated 11 December 2001 (copy attached) and on how the error arose.

2. This was a handling error that arose because the original instrument, when signed by the Lord Chancellor, was returned to the Court Service in Belfast without being signed, in addition, by two Lords Commissioners prior to its dispatch.

3. When the error was discovered an attempt was made to recover the instrument in transit but this was not successful. What should have happened is that a fresh instrument duly signed by the Lord Chancellor and two Lords Commissioners should have been prepared by the Northern Ireland Court Service.

4. The inconvenience caused to the Committee is regretted.
