Memorandum from the Department for Environment, Food and Rural Affairs


1. The Committee has requested a memorandum in the following terms:

"Given that these regulations amend primary legislation, has the Minister responsible for them made a written statement regarding their compatibility with the Convention rights, in accordance with the guidance to departments on the Human Rights Act (see the Committee's 3rd report, Session 2000-2001). If not, explain why not. If so, explain why a copy was not supplied to the Committee."

2. No such written statement has been provided. The reason was oversight, for which the Department apologises. The Department considers that the Regulations are compatible with Convention rights.
