Memorandum from the Department for Work and Pensions

SOCIAL SECURITY (NOTIFICATION OF CHANGE OF CIRCUMSTANCES) REGULATIONS 2001 (S.I. 2001/3252)

1.In its letter of 13 November 2000 the Joint Committee requested that the Department submit a memorandum concerning the above regulations on the following point -

Explain the failure to comply with the 21 day rule in the case of this instrument, and why no such explanation was supplied to the Committee, as required by paragraph 5.22 of Statutory Instrument Practice.

2.The failure to comply with the 21 day rule in this case was an error. Unfortunately, insufficient time was left for re-printing the final copy of the regulations prior to laying them. The Department appreciates that the regulations could have been laid in typescript, but inadvertently this was not done. The consequent breach of the 21 day rule was overlooked and the Committee was not informed. The Department apologises to the Committee for this.
