First Memorandum from the Northern Ireland Office

ROYAL ULSTER CONSTABULARY (COMPLAINTS ETC.) REGULATIONS 2001 (S.R. 2001/184)

1. These Regulations which are laid today, were made on 27th April 2001, and will come into force on 2nd May 2001.

2. The Regulations, rely, in part, on section 65 of the Police (Northern Ireland) Act 2000, which permits Regulations under section 64 of the Police (Northern Ireland) Act 1998 to prescribe time limits for the consideration of complaints by the Ombudsman. This is achieved by Regulations 5(2), 7(1) and 8(1).

3. It is considered necessary to have the time limit provisions in place as soon as possible in order to protect the Ombudsman from a flood of old complaints. For this reason it has been necessary to breach the 21-day rule.
