3.  Memorandum from the Department of Health

  Thank you for your letter of the 3 July informing me that the Joint Committee on Human Rights was considering whether to report to each House on the human rights implications of the Bill and asking for any help or comments that we would like to give at this stage.

  I can confirm that the Department is happy to help the Committee in any way that we can. In the first instance, in accordance with guidelines announced in both Houses on 18 December 2001, the Department has commented on the human rights implications of the Bill in the explanatory notes. The Department has advised Ministers that the Bill as drafted (and this is, of course subject to changes following consultation) would be compatible with Convention rights. If there are specific points on which the Committee would like further advice, we will do our best to assist.
