Memorandum by the Ministry of Agriculture, Fisheries and Food

ANIMALS AND ANIMAL PRODUCTS (IMPORT AND EXPORT) (ENGLAND AND WALES) (AMENDMENT) (NO. 1) REGULATIONS 2000 (S.I. 2000/2524)

1. The Joint Committee has requested a memorandum on the following question—

    This instrument came into force on 15 September 2000 before it was laid on that day. Has the Department sent to the Lord Chancellor and the Speaker of the House of Commons a notification as required by the proviso to section 4(1) of the Statutory Instruments Act 1946? If so, when, and if not, explain why no notification was sent.

2. As the Ministry's voluntary memorandum of 15 September [not printed] indicated, this instrument was brought into force with some urgency in order to comply with Community legislation. The Ministry acknowledges that it overlooked the requirement to notify the Lord Chancellor and the Speaker of the House of Commons in cases where a statutory instrument is made to come into force before it is laid, and apologizes for the error.
