Memorandum by the Northern Ireland Office

TRANSPORT OF EXPLOSIVES (SAFETY ADVISERS) REGULATIONS (NORTHERN IRELAND)

2000 (S.R. 2000/171)

  1. The Joint Committee on Statutory Instruments considered the above instrument on 20 June 2000 and requested the Northern Ireland Office to submit a memorandum on the following points

    "1.Verify the following references -

    (a)in regulation 5(1) to regulation 7(10) (which does not exist);

    (b)in regulation 7(7), to "the examination referred to in" regulation 7(5) (which contains no such reference).

    Should these references be to regulations 7(9) and 7(6) respectively?"

  2. Schedule 1 paragraph 1(b) purports to disapply these Regulations in the case of vehicles exempted from excise duty under paragraph 21 of Schedule 2 to the Vehicle Excise and Registration Act 1994. Is it not the case that paragraph 21 was repealed by Schedule 29 Part V of the Finance Act 1995?

  3. The Department accepts that the reference in regulation 5(1) to regulation 7(10) is incorrect. The reference should be to 7(9). The Department also accepts that the reference in regulation 7(7) is incorrect, but considers that the reference should be to 7(4) rather than 7(6).

  4. In relation to paragraph 21 of Schedule 2 to the Vehicle Excise and Registration Act 1994 the Committee is correct in stating that the paragraph was repealed by Part V of Schedule 29 to the Finance Act 1995.

  5. The Department will bring forward amendments to these regulations at the earliest opportunity.
