Joint Committee on Statutory Instruments Twenty-Third Report

APPENDIX 2

Memorandum by the Department of Health

MEDICINES (ARISTOLOCHIA AND MU TONG ETC) (TEMPORARY PROHIBITION) ORDER 2000

  (S.I. 2000/1368)

  1. The Committee has requested a memorandum on the following point:

Explain why this instrument was laid with a text amended in manuscript beyond the allowance made in paragraph 4.12 of the Statutory Instrument Practice.

  2. The Department followed its usual practice of laying the amended proof of the instrument as soon as possible following making and registration, in order to give the Committee the maximum opportunity to consider the instrument. It was unfortunately not appreciated, when laying the instrument, that the number of manuscript amendments to the proof went beyond the allowance in paragraph 4.12. The Department apologises for this error and will take steps to ensure that it is not repeated.
