Joint Committee on Statutory Instruments Twenty-Second Report


Memorandum by the Department of Trade and Industry


  1. The Committee has asked the Department to submit a Memorandum on the following point:

    "Relevant prior amendments to the (long and complex) 1994 Order, which (as footnote (c) to article 1(2) indicates) has been amended at least nine times already, are only listed (in that footnote) by reference to the 1994 Order taken as a whole. Recognising that the Statutory Instrument Practice paragraph 2.66) does not require individuated footnotes, will the Department consider adopting in future the more helpful approach in cases of this kind (where new amendments are not easily followed without them) of supplying separate footnotes which attribute past amendments to the individual provisions of the principal instrument which are affected?"

  2. The Department is happy to consider adopting a more helpful approach to the identification of prior amendments and the provisions of the principal instrument to which they related. In this context, the Committee may care to note that officials in the Department are currently working on preparation of an Order updating the 1994 Order and consolidating all the amendments so far made to it.
