Memorandum by the Department of Trade and Industry


  1. The Committee has requested a memorandum on the following point:

    Article 35(2) purports to amend section 23(3) of the Greater London Authority Act 1999. Given that section 23 contains no subsection (3) and does not deal with disclosure of information, identify the provision in the 1999 Act which is intended to be amended.

  2. Article 35(2) should have referred to section 235 of the 1999 Act, which has the sidenote "restrictions on disclosure of information", as cited in parentheses in article 35. The intended effect of article 35(2) was to repeal a reference to the Restrictive Trade Practices Act 1976 which became redundant following the repeal of that Act by the Competition Act 1998 with effect from 1 March 2000. The purpose of article 35(2) was to tidy up the existing legislation. We consider the repeal does not have a substantive effect.

  3. The final Departmental draft copy of the Rules which went for printing correctly states that the provision in the 1999 Act which is to be amended is section 235. The omission of the number "5" from "235" was an error in proof printing which we failed to identify and remedy before signature and publication. The Department apologises for this error, which will be rectified at the next available opportunity.
