Memorandum by the Department of the Environment, Transport and the Regions

MANAGEMENT OF HEALTH AND SAFETY AT WORK REGULATIONS 1999 (S.I. 1999/3242)

  1. The Committee has requested a memorandum on the following point:

    Paragraph (4) of regulation 19 provides that the provisions contained in that regulation are without prejudice to - (a) the provisions contained elsewhere in the Regulations, and (b) any prohibition or restriction, arising otherwise than by this regulation, on the employment of any person. Given that the Department has acknowledged that this provision does not serve any particular purpose, explain why the Department has not followed the recommendation in the Committee's Fourteenth Report (1996-97) on S.I. 1997/135 that this is an unnecessary provision to be removed at the next opportunity.

  2. The inclusion of this provision is regretted and the Department apologies for its oversight in failing to rectify this point when consolidating and amending the Management of Health and Safety at Work Regulations 1992. The Department will amend the Regulations at the earliest opportunity.
