Memorandum by the Department of the Environment, Transport and the Regions

WATER SUPPLY AND SEWERAGE SERVICES (CUSTOMER SERVICE STANDARDS) (AMENDMENT) REGULATIONS 2000 (S.I. 2000/2301)

1. The Committee has requested a memorandum on the following points:

"Explain:

      (a)  What is meant in regulation 3(1) of the 1989 Regulations, as substituted by regulation 2(3), by "decides to visit premises of a customer...which requires access to be afforded to the representative...";

      (b)  who is the representative referred to."

Question (a)

2. The words quoted are intended to describe a situation where it is proposed that a representative of a water or sewerage undertaker is to visit a customer's premises and the customer (or someone acting on his behalf) needs to be present when the representative visits so that the representative can gain access to the premises.

Question (b)

3. The representative referred to is the representative of the water or sewerage undertaker who proposes to visit the premises.

4. The Department regrets that the drafting of regulation 3(1) is defective and will correct the error as soon as possible.
