Memorandum by the Department of Trade and Industry


1. The Committee has requested the Department to submit a memorandum on the following point:

    "Explain why the preamble to the Regulations does not recite (as required by paragraph 2.26 of Statutory Instrument Practice) that the condition in section 6(2) or (3) of the Wireless Telegraphy Act 1998, which is to be complied with before regulations are made under the Act, has been complied with."

2. The omission of a recital in the preamble that section 6(2) had been complied with is an error which the Department regrets. The conditions in section 6(2) of the Wireless Telegraphy Act 1998, namely, the publication of a notice in the London, Edinburgh and Belfast Gazettes and the consideration of representations, was satisfied before the making of the Regulations.

3. These Regulations are the second in a series of Regulations, the first in the series being the Wireless Telegraphy (Third Generation Licences) Regulations 1999 (S.I. 1999/3162). The Department will ensure that subsequent Regulations in the series contain the required recital in their preambles.
