Memorandum by the Ministry of Agriculture, Fisheries, and Food

The Bovines and Bovine Products Trade Regulations 1999 (S.I. 1999/1103)

  1. The Committee has requested a memorandum on the following point on these Regulations:

      "There is nothing in the opening words of regulation 13(2) which indicates who is to be responsible for compliance with the requirements of sub-paragraphs (a)—(c). Indicate who the responsible person is intended to be."

  2. The person responsible for compliance with these requirements is intended to be the operator of "the establishment" referred to in these opening words. This is an establishment approved under regulation 12. This is clear from the heading and from the other provisions of the regulation which impose duties on operators. However the Ministry agrees that an express reference to such operators in the opening words of regulation 13(2) should have been made to make this clear; its omission was a mistake. The Ministry will seek to amend the Regulations in so far as they apply in England to include such a reference at the earliest possible opportunity.
