Memorandum by the Scottish Office

  1. This Memorandum is submitted to the Joint Committee on Statutory Instruments in response to their letter of 5 May 1999 in which they asked for an explanation of the following point:

    "Are these Regulations made in implementation of the same Community instruments as were the principal Regulations (S.I. 1995/3295) or others also? In either case, why were the Community instruments being implemented not mentioned in the explanatory note (see paragraph 2.101 of Statutory Instrument Practice)?".

The first question

  2. The Regulations amend the Rural Diversification Programme (Scotland) Regulations 1995 ("the principal Regulations"). The principal Regulations implement Council Regulation (EEC) No. 4256/88 laying down provisions for implementing Council Regulation (EEC) No. 2052/88 as regards the European Agricultural Guidance and Guarantee Fund (EAGGF) Guidance Section, as amended by Council Regulation (EEC) No. 2085/93. They enable financial assistance to be received from that Section under approved programmes contained in the Single Programming Documents (SPDs) for the four Objective 5b areas in Scotland approved by the Commission Decisions of 21 April 1995. By Commission Decisions of 23 October 1998, 9 November 1998 and 11 November 1998, the SPDs were amended. The above Regulations implement the amendments to the SPDs made by those Commission Decisions.

The second question

  3. The Community instruments being implemented were not mentioned in the explanatory note due to an oversight for which the Department apologise.
