Memorandum by the Department of the Environment, Transport and the Regions


  1. The Committee has requested a memorandum on the following point:

    Article 2 amends article 5(2) of the Rail Vehicle Accessibility (Midland Metro T69 Vehicles) Exemption Order 1999 (S.I. 1999/520) by substituting 31 March 2001 for 31 Dember 2010 as the termination date for an exemption granted by that Order. Has this amendment been made to correct a defect in the earlier instrument? If so, explain whether arrangements have been made (as required by paragraph 3.24 of Statutory Instrument Practice) for copies of the amending instrument to be made available free of charge to all known recipients of the earlier one.

  2. The Department confirms that the amendment was made to correct a defect and that arrangements have now been made for the amendin instrument to be made available free of charge to recipients of the earlier oder. steps are being taken to bring this to the notice of those most likely to be affected by the earlier order and the amending instrument. The Department apologises for omitting to make these arrangements when the order was made.
