Memorandum by the Scottish Office

RESTRICTION OF LIBERTY ORDER (SCOTLAND) AMENDMENT REGULATIONS 1999 (S.I. 1999/144)

  1.  This Memorandum is submitted to the Joint Committee on Statutory Instruments in response to their letter of 24th February 1999 in which they asked for a memorandum on the following point:

    Regulation 2 defines "the Principal Regulations" as meaning the Restriction of Liberty Order (Scotland) Regulations 1998, "unless the context otherwise requires". Identify the context in which "the Principal Regulations" has some other meaning.

  2.  The Department accepts the Joint Committee's criticism of the drafting here and is grateful to the Joint Committee for drawing it to their attention. There is, as the Joint Committee rightly noticed, no other context here in which some other meaning might be necessary. The Department will seek in future to avoid superfluous and redundant language in drafting its Statutory Instruments.
