6. The Committee draws the
special attention of both Houses to these Regulations on the ground
that they are defectively drafted.
7. Regulation 2 defines
"the Principal Regulations" as meaning the Restriction
of Liberty Order (Scotland) Regulations 1998 "unless the
context otherwise requires". In response to a question by
the Committee, the Scottish Office admit that there is actually
no context in which some other meaning might be necessary (Appendix
III). The Committee reports regulation 2 as being defectively
drafted, acknowledged by the Department.
