Memorandum by the Scottish Office

ROAD WORKS (REGISTER, NOTICES, DIRECTIONS AND DESIGNATIONS) (SCOTLAND) AMENDMENT REGULATIONS 1988 (S.I. 1998/2254)

1.  This Memorandum is submitted to the Joint Committee on Statutory Instruments in response to their letter of 11 November 1998 in which they ask for an explanation of the following point arising in connection with the above Statutory Instrument.

2.  The Committee seeks an explanation as follows:—

    Since this instrument corrects an error in an earlier instrument (S.I. 1997/1505), please explain whether arrangements have been made (as required by paragraph 3.24 of Statutory Instrument Practice) for copies of the amending instrument to be made available free of charge to all known recipients of the earlier one. If so, explain why the amending instrument does not bear a headnote to that effect (see paragraph 3.25 of Statutory Instrument Practice).

Explanation

3.  That the instrument did not bear a headnote to the effect that it was to be issued free of charge to all known recipients was an error. The instrument was issued free of charge to all 32 Scottish local authorities and to 12 national utilities. HMSO have been instructed to issue a copy of the instrument free of charge to those who can show that they bought the original defective instrument (S.I. 1997/1505) or who now buy the original defective instrument.
