Joint Committee on Statutory Instruments Forty-Seventh Report

APPENDIX VI

Memorandum by the Department of the Environment, Transport and the Regions

DARTFORD—THURROCK CROSSING REGULATIONS 1998 (S.I. 1998/1908)

The Committee have asked the Department to submit a memorandum on the following point:

Part II of the Table in regulation 4(1) prescribes the charge payable for the use of the bridge by a vehicle of the specified dimensions; where the overall width is greater than 3.65 metres but less than or equal to 6.1 metres and passage occurs during the day, the charge payable is 40; where the overall width is greater than 3.76 metres but less than or equal to 6.1 metres and passage occurs during the night, the charge is 20. Ought not the underlined figure to have read "3.65"?

The Committee are correct. The lower width figure for passage by night should be 3.65 metres. The insertion of the incorrect figure of 3.76 metres was due to an oversight. It should be pointed out that the difference is small (4 inches) and it is unlikely to have much practical effect in terms of loss of toll revenue, but steps will be taken to correct the error by making and laying appropriate amending Regulations.
