Memorandum by the Department of the Environment for Northern Ireland

PORTS (LEVY ON DISPOSALS OF LAND, ETC.) (AMENDMENT) ORDER (NORTHERN IRELAND) 1998 (S.R. 1998/148)

In its letter of 13 May 1998 regarding the above-mentioned Order the Committee requested a memorandum on the following point:

Since this instrument corrects an error in an earlier instrument (S.R. 1997/12) explain whether arrangements have been made (as required by paragraph 3.24 of Statutory Instrument Practice) for copies of the amending instrument to be made available free of charge to all known recipients of the earlier one. If so, explain why the amending instrument does not bear a headnote to that effect (see paragraph 3.25 of Statutory Instrument Practice).

The Department has not made any arrangements for the free issue of copies of the amending instrument. Hence, the amending instrument does not bear any headnote.

The Department regrets the fact that it overlooked the requirement to make the arrangements and will endeavour to ensure that they are made in future.

Second Memorandum by the Department of the Environment for Northern Ireland

The Committee considered the above instrument at its meeting on 2 June and requested a further memorandum on the following point:

Explain whether the Department intends to make arrangements for the free issue of the amending instrument (S.R. 1998/148) to all known recipients of the earlier one (S.R. 1997/12) and, if not, why not.

The Department has made arrangements for the free issue of the amending instrument to all known recipients of the earlier one.
