First Memorandum by the Department of Social Security

NAVAL, MILITARY AND AIR FORCES ETC. (DISABLEMENT AND DEATH) SERVICE PENSIONS AMENDMENT ORDER 1998 (S.I. 1998/262)

The Committee has requested a memorandum on the following point:

    "The Department in their memorandum of 29 July 1996 on S.I. 1996/1638, indicated that they would undertake a consolidation of the principal Order (S.I. 1983/883) as soon as circumstances and resources permit. Has work on consolidation begun? If not, when does the Department expect to commence this work?".

The Department has not yet commenced on the consolidation. This is regretted but is the consequence of pressure of other tasks and limited resources. Unfortunately at present we cannot see the situation changing, but it will be kept under review.

Second Memorandum by the Department of Social Security

The Committee has invited the Department to depute witnesses to attend its meeting on 7 April, in order to give oral evidence on this instrument. Before that meeting, it might be helpful if the Department makes the following points.

The Department has taken the opportunity to consider this matter further. The Department is participating with the Ministry of Defence in a joint review of compensation arrangements for service personnel whose death or injury is due to service in the armed forces. The intention is to publish a consultation paper in the summer. Priority is being given to this wide-ranging work. It is possible that decisions taken as a result of the review could impact on the provisions of the Service Pensions Order.

When the position is clear, which the Department believes will be by the end of this year, the Department plans to progress work on the consolidation rapidly. We fully share the view that the Order should be consolidated as soon as possible. We will try and make some progress during the summer, without waiting for the outcome of the review.
