Memorandum by the Scottish Office Pensions Agency


NATIONAL HEALTH SERVICE SUPERANNUATION SCHEME (SCOTLAND) AMENDMENT REGULATIONS 1997 (S.I. 1997/1434)

  1. This Memorandum is submitted by the Scottish Office Pensions Agency to the Joint Committee on Statutory Instruments in response to their letter dated 16 July 19997 in which they raised the following points:

    "In new regulation C1(3A) (inserted by regulation 5) explain the reference to "<<c0>> <<09>> <<01>> <<c0>>s". If this is a printing error, set out the text of the new regulation in the instrument signed by the Minister, and indicate whether a correction slip will be issued."

  2. The characters "<<c0>> <<09>> <<01>> <<c0>>s" are simply a printing error and were not in the principal Regulations as signed by the Minister. This error has been drawn to the attention of the Stationery Office who will issue a correction slip in due course.

  3. The text of the new regulation in the instrument signed by the Minister is as follows -

    "(3A) Where a member who was eligible to be a member before 1 June 1989 becomes a member on or after that date by virtue of being a person to whom regulation B6 applies, any amount by which that member's pensionable pay exceeds the permitted maximum will not be ignored when calculating the amount of any contributions or benefits payable under the Regulations except in relation to a period following a break in pensionable employment on or after that date.".
