Clause     10,     page     5,     line     35,     at end insert—

    '(2A)   No offence is committed under subsection (1) if—

      (a) the business referred to in subsection (2) is part of the tobacco trade,

      (b) the sponsorship agreement is for the purposes of that trade,

      (c) the purpose or effect of anything done under the agreement is to promote a tobacco product solely to persons who—

      (i) are engaged in, or employed by, a business which is also part of that trade, and

      (ii) fall within subsection (2AA).

    (2AA)   A person falls within this subsection if—

      (a) he is responsible for making decisions on behalf of the business referred to in subsection (2A)(c)(i) about the purchase of tobacco products which are to be sold in the course of that business,

      (b) he occupies a position in the management structure of the business in question which is equivalent in seniority to, or of greater seniority than, that of any such person, or

      (c) he is the person who, or is a member of the board of directors or other body of persons (however described) which, is responsible for the conduct of the business in question.'.

To move the following Clause:—

    '.—(1)   The Secretary of State may by order amend any provision of this Act if he considers it appropriate to do so in consequence of any significant developments relating to tobacco products.

    (2)   Before making an order under this section, the Secretary of State shall publish his proposals and consult such persons or bodies as appear to him to be appropriate.'.


Commission of body to study the effects of Act

To move the following Clause:—

    '(1)   The Secretary of State shall commission a reputable and appropriate qualified body to carry out a rolling study of the effects of this Act on—

      (a) the prevalence of smoking in the United Kingdom population, with particular reference to the uptake of smoking by persons between the ages of 16 and 19 and under the age of 16; and

      (b) the effect of this Act on market shares of different participants in the tobacco industry.

    (2)   Following the third anniversary of this Act coming into force, and annually thereafter, the Secretary of State shall arrange for an annual report of the findings of the study commissioned in accordance with subsection (1) above to be laid before Parliament.'.


EXTRACT FROM THE ORDER OF THE HOUSE [29TH APRIL]

    (3)   Proceedings in the Standing Committee shall (so far as not previously concluded) be brought to a conclusion on Tuesday 14th May.


ORDER OF THE COMMITTEE [7TH MAY]

       That—

      (1) during proceedings on the Tobacco Advertising and Promotion Bill [Lords] the Standing Committee, in addition to its first sitting on Tuesday 7th May at half-past Four o'clock, do meet on Thursday 9th May at Nine o'clock and at half-past Two o'clock, and on Tuesday 14th May at half-past Ten o'clock and at half-past Four o'clock;

      (2) the proceedings shall be taken in the following order, namely Clauses 1 to 5, Clause 17, Clauses 6 to 10, Clause 20, Clauses 11 to 16, Clauses 18 and 19, Clauses 21 and 22, New Clauses and New Schedules;

      (3) the proceedings on the Bill (so far as not previously concluded) shall be brought to a conclusion at Seven o'clock on Tuesday 14th May 2002.
